By using this site you are agreeing implicitly to the following Terms and Conditions Governing Law These terms and conditions and your use of this web site are governed exclusively by English law. Accessing and Using This Site Welcome to the International Property Rental website (‘the site’ or ‘this site’), which is owned by International Property Rental Ltd (‘IPR’). This site is an internet portal to enable (‘Property Advertisers’) to advertise their properties, with the sole purpose of enabling holiday makers, tenants or guests (‘Guests’) to book a holiday or rent a property for an agreed period of time. Property Advertisers, Guests and Sponsors are jointly referred to as (Users). A Property Advertiser’s property is also referred to as a property listing. The web-space is also a vehicle for advertisers to promote their businesses or resorts (‘Sponsors’), relevant to the properties and resorts being advertised by Property Advertisers. Please read these Terms and Conditions carefully, as they form a binding legal agreement with International Property Rental Ltd (‘the Company’, ‘we’ or ‘us’). You must fully agree to these Terms and Conditions to access this site. Property Listing Only one property per listing is permitted. Additional listings are charged at the published fee. A listing cannot be represented by generic images or information. Each listing must represent an actual property with specific images and descriptions. If a property to be listed contains multiple rental units, special additional fee arrangements can be administered. Replacing a property and related description on a listing is not permitted unless permission is obtained from the Property Advertiser. IPR reserve the right to amend or remove listings where Property Advertisers have an unapproved and ‘not paid for’ multiple rental property listing. No notice and no refund will be given. Responsibility for Content Submitted by Property Advertisers and Sponsors IPR are not responsible for the content submitted by Property Advertisers. We have no duty to verify and validate contributions for accuracy and authenticity. The Property Advertiser or Sponsor is solely responsible for accuracy and authenticity of details submitted. As the information supplied is not verified or validated for accuracy and authenticity, IPR strongly recommend that Guests make their own checks of the information supplied. IPR are not responsible for any misleading statements or inaccuracies made in the information supplied by Property Advertisers and Sponsors’ presentation and display on the site. We reserve the right to decline to accept a listing on our site or remove any content contributed by Users that fails to comply with our requirements. We also reserve the right to remove Property Advertisers’ content that has been brought to our attention by other Users or a third party, that breeches the terms or requirements of this clause for User submitted information. IPR reserve the right to reject a request to posting an advertisement on our site or remove some or all User submitted information that does not comply with our requirements. IPR reserve the right at all times to disclose any information, which may be requested by regulatory bodies, law enforcement or government agencies. Use of This Site There is a first monthly fee and the subsequent 11 months are free of charge for Property Advertisers to advertise their rental properties on this site. However, there is no charge for Guests to use this site, research the listings, raise enquiries to prospective Property Advertisers and book advertised properties. Continued use of the site by Users is granted, only if you agree not to utilise this site for any unlawful purpose, and, which is prohibited by these Terms and Conditions or by other statutory and legal regulations. Your continued use of the site indemnifies IPR from any loss, damage or costs arising from any breech of the conditions or other legal obligation by you, whilst using the site. Notification of Infringement of Content IPR’s aim is to provide an ethical and honest website that User’s and Sponsors feel confident to use. If you identify any content, whether submitted by Users or ourselves or any other features of the site, that you feel infringes the purpose of this site and these Terms and Conditions, please register your concerns via complaints@iprental.co.uk. Your communication will be logged and investigated. IPR are dependent on all Users to inform us of infringements in content, use or communication. Property Listing Termination Formal notification by email is required from a Property Advertiser to remove their listing from this site prior to the end of the subscription/fee term. One month’s notice will be required. The notice email must state: the property, Property Advertiser ID and password. Refunds will not be given. Copyright All materials on this web site are the copyright of IPR or are reproduced with permission from other copyright Property Advertisers. All rights are reserved. The materials on this web site may be retrieved and downloaded solely for personal use. No materials may otherwise be copied, modified, published, broadcast or otherwise distributed without the prior written permission of International property Rental Ltd. Other User’s Information Other Users’ information that you obtain as a result of using this website must be used only for the purpose for which it is intended. We have granted you a license to use this information.Other Users’ personal and confidential information must be protected by you in the same manner that you protect your own private and confidential information. As such, you will accept liability for loss, unauthorised transfer or misuse of their information. You must not in any circumstance disclose another Users’ information to a third party without (1) our authorisation and (2) the authorisation of the User. You must give the Users the option to (1) remove themselves from your records and (2) review the information you have collected about them. Copyright License Granted by Property Advertisers By accepting to post your property on this site, you permit us a non-fee-based, royalty free, irrevocable and unrestricted license - to fully utilise the content of your supplied copy, photographs and other submitted content, in order to promote your property on our website or affiliate sites – in perpetuity. You also allow us the freedom to copyright and protect such copy, images and other submitted content from unauthorised use by others not connected to the site. This permission is required to post and display your listings on our site. We are not responsible for any copyright infringement resulting from the website posting of User Submitted Content. It is the Property Advertiser’s responsibility to obtain permission for all non-Property Advertiser original material used in their listings. Additionally, all Property Advertisers submitting content, waive the right to claim against IPR for actual infringement of their submitted content. Authorisation to use the material is given by the Property Advertisers for their own original content and that authorisation to use submitted non-Property Advertiser original copy is also granted. Dispute with Other Users Should you have any dispute with another User or Users regarding the accuracy and authenticity of the User submitted information or any transaction; you agree to discharge us from any claims, liabilities and expenses arising out of said dispute. Links to Other Sites International Property Rental Ltd disclaims responsibility for any third party contents, which the User is able to access through this web site. If hyperlinks from adverts to external websites and email addresses provided by Property Advertisers are deemed to be inappropriate by IPR or contravene these Terms and Conditions and adversely affect the company or its Sponsors, we reserve the right to remove them. Links that are added without consent or if a link or email address is re-added after removal, we reserve the right to remove the Property Advertiser’s advert without refund. The ultimate responsibility and authority for determining the aforementioned, rests solely with International Property Rental. The website that your link goes to, should provide potential Guests with further information about your property or the region that the property is located in. Email Tools The ‘Send to a Friend’ facility is provided purely for your convenience. By using this, you agree that you have obtained consent from the recipient(s) for them to receive an email from our domain. No ‘Send to Friend’s addressee details are stored on IPR’s system and will not be used for sale or rent by us. The ‘Send to a Friend’ email address’ purpose is to be used only for you to send your emails via our domain. International Property Rental will be copied in on all emails.International Property Rental will also be copied in on emails sent via the ‘Contact all Owners’ facility. Confidentiality of Communications You acknowledge that email communications sent from this site may be intercepted and read by others, as this site is not confidential. Availability and Changes to the Site The provision of a continuous and defect free website is our aim. However, problems may occur of a technical nature, which affect the smooth running of the site. These problems may be caused by the internet provider, hosting company or ourselves. Additionally, we may need to amend any website element for commercial, technical, statutory or legal reasons. At such times, we will use reasonable expertise and care, when within our control, to re-establish the website, with the minimum down time. Consequently, we may also require to limit certain features or your access to the site. Continuous access to the site and its integral elements is not guaranteed. IPR does not accept any responsibility for any loss or damage, which may arise from the non-availability of our website. Indemnity You acknowledge that you are solely responsible for the use to which you put this web site and all the results and information you obtain from it and that all warranties, conditions, undertakings, representations and terms whether expressed or implied, statutory or otherwise are hereby excluded to the fullest extent permitted by law. Save in respect of liability for death or personal injury arising out of negligence or for fraudulent misrepresentation, we and all contributors to this website hereby disclaim to the fullest extent permitted by law all liability for any loss or damage including any consequential or indirect loss or damage incurred by you, whether arising in tort, contract or otherwise, and arising out of or in relation to or in connection with your access to or use of or inability to use this website. Consumer Protection We will provide you with a 7 day cooling off period. However, as we begin processing your property listing as soon as we receive your agreement to proceed, we will charge you a £20 cancellation fee. This fee will be subtracted from your refund. You will receive email notification following your notice to cancel. The email link, sales@iprental.co.uk is provided for this purpose. Payment for Advertising Payment for the registration of a new property on this site should be made, either online, via the secure WorldPay system, using a credit or debit card or by cheque, made payable to International Property Rentals Ltd and must be sent to: International Property Rentals Ltd, Newtown House, 38 Newtown Road, Liphook, Hants, GU30 7DX. Senders of cheques must notify IPR stating that a cheque is being posted, using the sales@iprental.co.uk link provided in the payment section of the site. If there is no notification, and the cheque is not received within 7 days, IPR reserve the right to remove the property listing from the site. Pricing IPR reserves the right to change the property listing fees without notice. New rates will be effective immediately for new Property Advertisers and upon renewal for existing Property Advertisers. Exchange Rate Changes Where property tariffs are posted in local tariffs, these are subject to fluctuations, based on current exchange rates. Value Added Tax VAT will be added to any purchase from UK Residents and UK Business Residents. VAT will not be added to any purchases from Residents or Business Residents from EU and Non EU Countries. Disclaimer Any dispute arising out of or in connection with the contents of this web site or the use of any information or materials contained in the web site shall be subject to the exclusive jurisdiction of the English courts. IPR does not accept any responsibility for any loss which may arise from reliance on information or documents contained on this site. PRIVACY STATEMENT Privacy and Security International Property Rental Ltd is committed to protecting your privacy online, whilst providing a safe, secure User experience. Any information collected by IPR on this site will be only that which is specifically required in order to provide our services to you or for information you have requested. Any additional/optional information being collected, will be used only for the purpose of our building a profile of our Users and promoting our own services to those of our Users that have opted for us to do so. Additionally, we may supply your details to our affiliate organisation(s) who will process your enquiry and details to meet your requirements. They will control your information in accordance with their Privacy Policies. Should the business be sold or merged with another business, your details may be disclosed to the new Owners of the business. IPR does not sell, rent or deal in the personal information submitted by you. By using this site you are deemed to have given consent for any personal details submitted in the ways described, to be used in those ways indicated. User Registration We request that you submit up to date relevant details to enable the correct fulfilment of our services to you. If your contact details change and you do not wish to receive information subsequent to registration, please email to enquiries@iprental.co.uk A full written record of all data we have stored about you is available on request. |
